UAE Introduces New Law to Strengthen Family Rights and Stability

The UAE Government has issued a new decree-law aimed at enhancing family stability, protecting the rights of family members, and promoting community cohesion. The law includes several provisions regarding personal status, marriage, and family welfare, with penalties for abuse, neglect, and other violations.

Key Highlights of the New Law:

  1. Protection of Parents:

    • Strict penalties for mistreatment, neglect, or abandonment of parents without care.
    • Legal action against individuals who refuse to provide financial support to their parents when required.
  2. Safeguards for Minors and Estates:

    • Penalties for actions such as squandering inheritance, embezzling estate funds, and traveling with a minor without proper permission.
    • Additional provisions to protect minors’ property from exploitation.
  3. Marriage and Divorce Regulations:

    • The legal age for marriage has been set at 18 years.
    • Courts can transfer guardianship for marriage to ensure fairness and safety.
    • Either spouse can request a divorce if the other is found addicted to drugs, psychoactive substances, or alcohol.
  4. Child Custody and Welfare:

    • Children aged 15 years or older have the right to choose which parent they wish to live with.
    • The law prioritizes the child’s best interests in all custody matters.
  5. Inheritance and Wills:

    • New rules for managing wills and inheritance to ensure transparency.
    • Urgent matters such as alimony, custody, and inheritance issues are exempt from referral to family reconciliation and guidance centres.
  6. Judicial Discretion:

    • Judges have the authority to refer cases to family reconciliation centres to expedite resolutions and ensure fair outcomes.

Purpose of the Law

The decree aims to reinforce family ties, ensure the rights and welfare of all family members, and address pressing social issues such as abuse, neglect, and addiction. By introducing these measures, the UAE seeks to create a safer, more supportive environment for its citizens and residents.
